1. HOW TO ENTER

a.      The Smooth Jazz V98.7 (WVMV-FM) “Detroit’s Phenomenal Five” contest (“The Contest”)will begin on Monday, January 21, 2008 at approximately 12:01 a.m. Eastern Time (“ET”) and end on Sunday, February 17, 2008, at approximately 12:00 Midnight ET. (“Contest Dates”)

b.      To participate in the Contest, beginning Monday, January 21, 2008 at 12:01 a.m., log on to www.smoothjazzdetroit.com, click on the Contest link and fill out the entry form with your legal first and last name, complete address, city, state, zip code, daytime telephone number, evening telephone number, date of birth and valid email address, name of nominee, the nominee’s phone number and/or valid email address, and a brief statement (“Nomination”) of up to 50 words to why you believe the nominee is a phenomenal individual who has made a grass roots impact in the metro Detroit business world or has reached out to help in the Metro Detroit African American community. Only one (1) internet entry per person and one (1) internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. All entries submitted become the sole property of WVMV-FM and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be seemed proof receipt by WVMV-FM. WVMV-FM’s computer is the official time keeping device for this Contest

The following request for marketing information will also be included on the entry form and is optional for registration into Contest: 

• Do you wish to receive additional marketing materials from Smooth Jazz V98.7?
• Do you wish to receive additional marketing materials from Fifth Third Bank?
• Do you wish to receive additional marketing materials from the Charles H. Wright Museum of African American History?

c.      Each submitted Nomination must be the original and creative work of each contestant and must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. WVMV-FM has the absolute discretion to disqualify any Nomination based on its sole judgment. WVMV-FM, in its sole discretion, reserves the right to disqualify any Nomination if such Nomination contains illegal, indecent or otherwise offensive material, or if such Nomination contains material whose content is deemed at the sole discretion of WVMV-FM to be unsuitable for the public (i.e. Nominations must be radio clean). Nominations that do not comply with these rules will not be eligible for the sweepstakes. All Nominations become the property of WVMV-FM and will not be acknowledged or returned. 

d.      Entries must be received by 12:00 Midnight ET on Sunday, February 10, 2008. 

e.      WVMV-FM is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.

2. ELIGIBILITY RESTRICTIONS

a.      The Contest is open to all persons who are 18 years of age or older at the time of entry and are legal United States residents living in Michigan in the Metro Detroit area. Employees of WVMV-FM, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Detroit metropolitan area and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws and regulations.

b.      Only one (1) winner per household is permitted in any WVMV-FM contest every thirty (30) days, or every six (6) months for prizes over $600 in value.

c.      Winners may have to present valid government-issued photo-identification and sign a release form from WVMV-FM in order to receive prize.

d.      Contestants are required to provide truthful information and WVMV-FM will reject and delete any entry it discovers to be false or fraudulent. WVMV-FM will disqualify any entry from individuals who do not meet the eligibility requirements, and WVMV-FM will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES

a.      Three (3) Prizes will be awarded. Each prize includes a plaque and an opportunity for the nominated Winner to be honored at a special luncheon at the Charles H. Wright Museum of African American History, 315 E. Warren Avenue, Detroit, MI 48226 on Friday, February 29, 2008 approximately 11:30 a.m. -1:30 p.m. Each nominated Winner will receive eight (8) tickets to the luncheon plus two (2) tickets for the listener submitting the winning Nomination. Also, each nominated Winner will be featured in a brief video presentation on-line at www.smoothjazzdetroit.com and their Nomination will be featured in an on-air vignette which highlights their contribution. The Approximate Retail Value (“ARV”) of each prize = $300.00.
 
b.      Ten (10) prizes will be awarded to contestants nominating or voting in the Contest.  Each prize is a one-year individual membership to the Charles H. Wright Museum of African American History, 315 E. Warren Avenue, Detroit, MI  48226.  Annual individual membershipo includes free admission to the Museum; invitations to Members' Only previews; Advanc notification of Special Events and Special Pricing on Select Museum Events.  Membership expires 2/28/09.  ARV of each prize = $35.00.

c.      Prize may be claimed at WVMV-FM, 31555 W. Fourteen Mile, Suite 102, Farmington Hills, MI 48334 during normal business hours, Monday- Friday from 8:30 a.m. – 5:30 p.m. ET. Winners will forfeit any prize not claimed by February 29, 2008. In the event that a prize or prize certificate is mailed to a Winner, it will be with the prior written consent of the Winner and therefore, Winner assumes the risk of its loss. WVMV-FM is not responsible for the safe arrival of a prize or prize certificate.

d.  There is no substitution, transfer, or cash equivalent for prize, except that Sponsor may, at its sole discretion, substitute prize of comparable value. The prize is expressly limited to the items listed above and does not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a.      Decisions of WVMV-FM management with respect to the Contest are final.

b.      Three (3) Winners will be chosen. The top ten (10) Nominations as determined by the Smooth Jazz V98.7 committee based on the criteria outlined in 4c will be posted at www.smoothjazzdetroit.com. Beginning February 11, 2008 – February 17, 2008 listeners can vote on-line for their choice to represent Detroit’s Phenomenal Five. On Tuesday, February 19, 2008 at approximately 10 a.m. EST the three (3) on-line Nominations receiving the most number of votes along with one (1) Nominee as determined by the Smooth Jazz V98.7 committee and one (1) Nominee as determined by a sponsor will be declared Detroit’s Phenomenal Five. 

c.      Ten (10) Winners will be selected from a random drawing from all eligible entries submitted in the nominating or voting phase of this Contest to receive a one-year membership to the Charles H. Wright Museum of African American History.  Winners will be drawn at random on Tuesday, February 19th at approximately 10 a.m.  Winners will be contacted by email within 48 hours of winner selection.

c.      In the case of a tie, the Nominations will be reviewed by a Smooth Jazz V98.7 committee and a Winner will be selected based on the nominator’s most impressive story as determined by the following elements: the nominee’s contribution to the Metro Detroit business world or communityand the nominator’s sentimental explanation.

d.      If a Winning Nominee or designated representative cannot attend luncheon the prize will be forfeited and alternate winner will be selected by the Smooth Jazz V98.7 committee based on the criteria outlined in 4c.    

e.      Odds of winning depend in part upon the number of eligible Nominations received.

f.        Winners need not listen nor be present to win.

g.      Winners will be contacted by emailand/or phonewithin twenty-four (24) hours following the selection of Winner. If Winners cannot be reached within two (2) days of notification attempt, an alternate winner maybe selected by the Smooth Jazz V98.7 committee based on the criteria outlined in 4c. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within five (5) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by the Smooth Jazz V98.7 committee.

5. CONDITIONS

a.      Payments of all federal, state and local taxes are solely the responsibility of the Winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b.      By participating in the Contest, Winners and their guests, agree to have their Nominations, names, voices, or likenesses used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c.      Prior to awarding any prize or prize certificate, WVMV-FM in its sole discretion may require Contest Winners and his or her guest if applicable, to sign a liability release prior to acceptance of prize or use of their Nomination, agreeing to hold WVMV-FM, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

d.      By participation in this Contest, all Winners agree to fully transfer all right, title and interest to the submitted Nominations to Sponsor without compensation (including but not limited to publicity rights and copyrights). No royalties, copyright fees, license fees, talent fees, or any other compensation will be paid for any reason relating to any aspect or part the submitted Nomination, even if reproduced, distributed, and/or sold by Sponsor. Sponsor shall have the right to use any aspect or part of the submitted Nomination, including Winners name, likeness and image, for any commercial or marketing purposes without additional compensation, in perpetuity. Notwithstanding the foregoing, nothing herein requires that Sponsor use the winning Nomination.

e.      WVMV-FM, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WVMV-FM web site or who is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, tampering, unauthorized intervention or technical failures of any sort. All Internet participants agree to be bound by these rules, and the Official Rules appearing above.

f.        WVMV-FM reserves the right to make changes in the rules of the Contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.

g.      Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of WVMV-FM.

h.      WVMV-FM is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
